By using our website (Prelova.com and its subdomains) or making transactions in our physical stores (collectively, the "Prelova Experience"), you agree to these Terms and Conditions. These terms govern your interaction with Prelova, the owner and operator of the Prelova Experience.

1. Definitions:

Prelova: Refers to Prelova, its stores, and any franchised locations.

Cookies: Small data files stored on your device by our website to remember your preferences and shopping cart.

Customer/User: Anyone who buys, sells, or browses products with Prelova, either online or in-store.

Exchanging: Trading one product for another, potentially involving additional payment or store credit.

Personal Information: Data you provide when registering or transacting with us, such as your name and contact details.

Products: Any furniture or household items bought, sold, or traded with Prelova.

Product Description: The information provided on our website about each product.

Selling: Offering a product to Prelova for purchase.

Store: A physical Prelova location.

Website: Our online platform located at Prelova.com (and any future URLs).
PART I - General Terms Applicable to Online and In-Store
2. Product Warranty:

12-Month Warranty: Prelova warrants that our second-hand furniture will be free from defects in materials and workmanship for 12 months from the purchase date, covering repair or replacement of defective parts at our discretion (see 2.1.2 for exceptions).

2.1.1 Warranty Exclusions: This warranty does not cover: damage from misuse, accidents, normal wear and tear, acts of God, or items not purchased from Prelova.

Warranty Claims: To make a claim, contact us within 30 days of discovering the defect with proof of purchase and allow inspection. We will repair or replace the item free of charge, or issue a credit if repair/replacement isn't possible.

2.1.2 Consumable Parts: Removable parts like batteries, bearings, wheels, screws, bolts, and bulbs are covered for 30 days from purchase.

2.2 Personal Property: Prelova is not responsible for any personal items left in furniture brought to us for any reason. It is your responsibility to remove all personal belongings.

2.3 Fault Within 30 Days: Full refund to your original payment method upon verification of a fault within 30 days of purchase.

2.4 Fault Between 30 Days and 6 Months: Defective items will be tested. If faulty, we will repair or replace the product. If a prior repair/replacement fails again, the refund will be the original purchase value. Refunds within 6 months are for the original amount paid.

2.5 Fault Between 6 and 12 Months: We will repair or replace faulty products. If a prior repair/replacement fails again, the refund will be the current or original value, whichever is lower.

2.6 Shipping Risk: For warranty returns, the risk of loss and ownership remains with you until the product is received by Prelova.

2.7 Warranty Limitations: This warranty does not cover damage from accidents, misuse, neglect, improper installation, maintenance, voltage, interference, unauthorized modifications, or service.

2.8 User Responsibility: Prelova is not liable for any damage or injury caused to or by the user resulting from the misuse, neglect, or modification of products sold by us.
3. Returns Policy:

3.1 Fault Within 14 Days: Full refund to your original payment method upon verification of a fault within 14 days of purchase.

3.3 Testing Required: All returns are subject to testing and fault verification before any refund, repair, or replacement is issued.
4. Unwanted Product Policy:
Unwanted items can be returned within 48 hours of sale for a full refund as a Prelova voucher, subject to testing/inspection and the item being in the same condition as sold. Prelova reserves the right to limit the number of exchanges to prevent abuse.
5. Description of Products:

5.1 Product Variations: Second-hand furniture may have minor wear consistent with age and use. Specific features mentioned may not be included. We cannot guarantee exact condition until inspection.

5.2 Product Images: Images are for illustration only. Actual items may vary slightly in color, texture, or minor details.

5.3 Product Condition Grading: Condition is based on appearance and functionality, with grades (e.g., A to C) subject to assessment. Detailed reports are available upon request.

5.4 Furniture Specifics: Furniture may have original or refurbished coverings. Mechanisms may show use but remain functional. Structural issues will be disclosed and priced accordingly.

5.5 Price Adjustments: Prelova reserves the right to change prices without notice due to market conditions, inventory, and item condition.

5.6 Customer Responsibility: Inspect furniture before purchase. Prelova is not liable for personal belongings left in furniture.
6. Buying from Prelova:

6.1 Accessories: You are responsible for ensuring you have necessary accessories (power cables, adapters) for safe use. We do not provide additional equipment or technical support.

6.2 Purchase Limits: To ensure fair access, we may limit the number of items sold to an individual customer.
7. Selling to Prelova:

7.1 Purchase Decision: Prelova reserves the right to decline any item for purchase at our discretion.

7.2 Purchase Limits & Bulk Discounts: We may limit the number of items purchased. Bulk discounts may apply for multiple similar items, with the final price confirmed before purchase. A contract is formed upon your acceptance of the bulk discount price.

7.3 Ownership & Warranty (Selling): By selling to us, you transfer ownership and warrant that you are the rightful owner, and the items are free from encumbrances. We reserve the right to legal action if items are stolen, encumbered, or counterfeit.

7.4 Payment & Vouchers: Prices are subject to change. Payment can be cash, bank transfer, or voucher. Cash and voucher offers may differ. Vouchers are non-transferable, have no cash value, and you are responsible for any voucher fraud. Voucher holders are considered the rightful owners.

7.5 items (Selling): You are responsible for removing all items from furniture sold to Prelova.

7.6 Voucher Redemption: If a voucher balance is insufficient, the difference must be paid using another voucher, cash, or accepted payment method.
8. Registration/Membership:

You warrant that your provided personal information is true, accurate, current, and complete.

You agree to keep your account information updated.

You will not use a false identity or impersonate another person.

8.2 Membership Account: A membership account is required for all online and in-store transactions.
9. Intellectual Property Rights:

9.1 Copyright: All content on the Prelova website and in-store is owned by Prelova or its suppliers and protected by UK and international copyright laws.

9.2 Trademarks: Prelova and related marks are registered trademarks of Prelova or its subsidiaries in the UK and other countries.

10. Limitation of Liability:

11.1 Accuracy: While we strive for accuracy, Prelova makes no warranties regarding the information on the website or in-store.

11.2 Excluded Losses: Prelova will not be liable for any economic losses, loss of goodwill or reputation, or any special or indirect losses.

11.3 Liability Cap: Our total liability for any defect or breach of these terms is limited to the price of the specific products in question.
11. Severance:
If any part of these Terms of Use is deemed unlawful, void, or unenforceable, that part will be removed without affecting the validity of the remaining terms.

12. Indemnity:
You agree to fully indemnify Prelova against any third-party claims arising from your negligence.
13. Notice:
Notices under these Terms of Use may be sent by hand, post, registered post, or recorded delivery and are deemed received during normal business hours.
14. Franchise Businesses:
Please note that Prelova also operates franchise businesses, which are separate legal entities adhering to the Prelova business model and obligations under their franchise agreements.
15. Applicable Law and Dispute Resolution:
By transacting with Prelova, you agree to be governed by the laws of England and Wales.
16. Data Protection:
Please refer to our Privacy Policy for details on how we handle your personal data.
17. Age Restrictions:

17.1 Purchasers confirm they are of the appropriate age to view and receive the certified content of the products ordered/purchased.

17.2 Those ordering on behalf of a third person must ensure the recipient is of the appropriate age.

17.3 Users under 16 may only use the website with parental or guardian involvement.
Prelova and its affiliates reserve the right to refuse service, terminate accounts, remove content, cancel orders, or refuse sale in-store if not accompanied by a parent or guardian.
18. Force Majeure:
Prelova is not liable for any failure to perform our obligations due to events beyond our reasonable control, such as acts of God, war, strikes, fires, floods, etc.
PART II - Online Only Terms
19. Buying, Selling, and Exchange of Products Online:

19.1 Buying from Prelova Online:

An online order is a binding contract when dispatched by Prelova, unless cancelled by us due to stock unavailability, payment issues, ineligibility, or breach of these terms.

Orders can be cancelled until dispatched.

Unwanted products can be returned within 14 days under distance selling regulations. Outside this period, refunds/exchanges for non-faulty items are at Prelova's discretion.

We only deliver to the UK billing address or the registered UK PayPal address used for the transaction. We are not liable for delivery issues due to incorrect addresses provided by you.

19.2 Selling to Prelova Online:

You must dispatch the products you are selling to us promptly, and they must be received at our designated location within 10 days of your order placement. Quoted prices may change or orders may be cancelled if not received within this timeframe.

The risk of loss and ownership remains with you until we receive the products.

Your entire order should be sent at the same time. We are not responsible for incomplete orders and will process only received items, cancelling the rest.

We are not liable for payments made to incorrect accounts due to inaccurate details provided by you.

The value offered for your products may be reduced upon receipt based on their condition or quantity.

20. Delivery (Online Orders):

20.1 Delivery is complete when Prelova hands over the product to the customer.

20.2 Late delivery does not entitle the customer to reject the products, cancel the order, or withhold payment.
21. Failed Products (Online Selling):

21.1 Products failing our testing will be returned if requested.

21.2 Tracking numbers can be provided upon request once sent.

21.3 Prelova is not responsible for lost or damaged products among failed returns.
22. Our Rights (Online):
Prelova reserves the right to change these Terms of Use at any time. Your continued use of the website after changes constitutes acceptance. If you disagree with changes, you must stop using the website immediately.
23. Third-Party Links (Online):
Prelova is not responsible for the content of any third-party websites linked from our site.
24. Cookies and Other Technologies (Online):
Please refer to our Cookie Policy for information on our use of cookies and similar technologies.
PART III - Stores Only Terms
25. General (In-Store):
The contract between Prelova and you for products is formed when your order is accepted by Prelova in accordance with these Terms of Use.
26. Selling to Prelova (In-Store):
Ownership of products sold to Prelova transfers upon successful testing and agreement on a purchase price.
27. Testing of Products (In-Store):

28.1 Risk: Products left for testing are left at your own risk, although we will take reasonable care.

28.2 Collection of Rejected Items: Products that fail testing or are rejected for purchase will be held for 14 days for collection. After 14 days, Prelova may dispose of them at your expense.
